Food Contact Materials (FCM) refer to any materials or articles intended to come into contact with food or beverages during manufacturing, packaging, storage, preparation, or consumption. In the United States, Food Contact Substances (FCS) are strictly regulated by the U.S. Food and Drug Administration (FDA) under Title 21 of the Code of Federal Regulations (21 CFR) 1.

Importers sourcing kitchenware, food containers, water bottles, and food processing machinery must ensure full compliance with FDA material safety directives to prevent product detentions at US ports of entry2.


Regulatory Pathways: Direct Additives vs. Food Contact Substances

Under US law, any substance that reasonably may be expected to become a component of food is classified as a Indirect Food Additive, requiring one of three legal authorization pathways:

  • 21 CFR Specific Regulation: The substance is explicitly listed as safe under Title 21 of the CFR (e.g., 21 CFR 177 for polymers, 21 CFR 175 for adhesives and coatings).
  • Food Contact Notification (FCN): A proprietary authorization granted by the FDA for a specific food contact substance produced by a specific manufacturer3 .
  • GRAS Designation: The substance is Generally Recognized As Safe (GRAS) among qualified experts for its intended use conditions.

Conditions of Use (COU) and Food Simulants

FDA extraction testing simulates real-world food contact conditions by subjecting materials to specific food simulants under controlled temperature regimes:

  • Food Simulants: Distilled water (aqueous food), 8% or 50% ethanol (alcoholic food), n-heptane (fatty food), and 3% acetic acid (acidic food).
  • Conditions of Use (COU A through H): Testing ranges from COU A (High-temperature heat-sterilized above 212 degrees F) down to COU H (Frozen storage without thermal treatment).


Practical Module: On-Site FDA Compliance & Lab Testing Practice

To ensure bulk shipments of food contact products comply with FDA standards, importers and QC inspectors should carry out the following protocol:

Step 1: Raw Material Bill of Materials (BOM) Audit

  • Require the manufacturer to provide a complete raw material formulation breakdown, including base resins, plasticizers, colorants, and processing aids.
  • Verify that every raw material grade listed in the BOM explicitly conforms to 21 CFR specifications or holds an active FDA Food Contact Notification (FCN) number.

Step 2: Sampling for Laboratory Extraction Testing

  • During a Pre-Shipment Inspection (PSI), randomly select final production units (e.g., stainless steel travel mugs with silicone gaskets).
  • Ensure the laboratory performs extraction testing separately on every distinct food-contact component (e.g., inner stainless steel liner, plastic lid, silicone sealing ring).

Step 3: Physical Marking and Heavy Metal Screening

  • On-Site XRF Screening: Use a portable XRF analyzer to screen ceramic glazes or metal coatings for heavy metals (lead, cadmium, chromium) prior to shipment.
  • Traceability Markings: Verify that packaging displays clear care instructions, model numbers, and food-safe icon markings where applicable.
